It was expected that the changes made under the new Law should bring the national legislation closer to the European standards in <a href=\"https:\/\/zuniclaw.com\/en\/practice-areas\/intellectual-property-law\/\">trademark law<\/a>. Aside from the novelties related to <a href=\"https:\/\/zuniclaw.com\/en\/trademark-registration\/\">trademark proceedings<\/a> (registration, renewal, etc.), the Law also introduced changes that, turns out, hold great commercial value.<\/p><p>Among some of the more significant novelties and changes, we highlighted the following:<\/p><\/div><\/section><div class=\"av-special-heading av-3i0acwl-a19ccc1f8358e56f5dd6551e161f1c42 av-special-heading-h2 blockquote modern-quote modern-centered avia-builder-el-12 el_after_av_textblock el_before_av_textblock av-linked-heading\"><h2>\u00a0<\/h2><h2 class=\"av-special-heading-tag\">Opposition System and The New Proceedings Framework<\/h2><\/div><section class=\"av_textblock_section av-jnfrqfkn-22e29912b7f06bc73898def3aac67ddc\"><div class=\"avia_textblock linkz\"><p>\u00a0<\/p><p>The opposition system in the trademark registration procedure is the most important novelty under the new Law. By introducing the opposition system, the trademark registration proceedings are now as follows:<\/p><\/div><\/section><div class=\"avia-image-container av-1c3npho-5fef640c99ec3ba7b8e23af2f9f0fdb4 av-styling- avia-align-center avia-builder-el-14 el_after_av_textblock el_before_av_textblock \"><div class=\"avia-image-container-inner\"><div class=\"avia-image-overlay-wrap\"><img fetchpriority=\"high\" decoding=\"async\" class=\"wp-image-21462 avia-img-lazy-loading-not-21462 avia_image \" src=\"https:\/\/zuniclaw.com\/wp-content\/uploads\/2020\/03\/imageedit_1_9083457536.jpg\" sizes=\"(max-width: 1030px) 100vw, 1030px\" srcset=\"https:\/\/zuniclaw.com\/wp-content\/uploads\/2020\/03\/imageedit_1_9083457536.jpg 1030w, https:\/\/zuniclaw.com\/wp-content\/uploads\/2020\/03\/imageedit_1_9083457536-300x90.jpg 300w, https:\/\/zuniclaw.com\/wp-content\/uploads\/2020\/03\/imageedit_1_9083457536-768x230.jpg 768w, https:\/\/zuniclaw.com\/wp-content\/uploads\/2020\/03\/imageedit_1_9083457536-705x212.jpg 705w\" alt=\"\" width=\"1030\" height=\"309\" \/><\/div><\/div><\/div><section class=\"av_textblock_section av-k7q7tsvs-9a1cfa50eb2c01989e3b945c9b52e295\"><div class=\"avia_textblock\"><p>\u00a0<\/p><p>The opponent may file a notice of opposition <strong>within 3 months<\/strong> of the publication of the trademark application. That can be done on the grounds of <strong>relative and special reasons<\/strong>. It is of great importance to note that the Law also enables the applicant to file a response to the opposition notice (within 60 days of receiving the opposition).<\/p><p><strong>Publication of the application in the official gazette<\/strong> is also introduced. As aforementioned, the opposition notice can be filed 3 months from the date of publication of the application. The publication aims to increase transparency in <a href=\"https:\/\/zuniclaw.com\/en\/trademark-protection\/\">the trademark registration process <\/a>and to enable opponents to stop the registration of a trademark that would infringe on their rights.<\/p><\/div><\/section><div class=\"av-special-heading av-2t3aowl-f5607d50dcaa20a6a8f2a2a8ce4eb429 av-special-heading-h2 blockquote modern-quote modern-centered avia-builder-el-16 el_after_av_textblock el_before_av_textblock av-linked-heading\"><h2>\u00a0<\/h2><h2 class=\"av-special-heading-tag\">Exhaustion System Change \u2013 Parallel Imports<\/h2><\/div><section class=\"av_textblock_section av-jnfrqfkn-22e29912b7f06bc73898def3aac67ddc\"><div class=\"avia_textblock linkz\"><p>\u00a0<\/p><p>In addition to the previously mentioned opposition, the change of the provision concerning the exhaustion of rights constitutes the most significant novelty of the Law in the commercial sense. The economy has certainly felt the effects of this change.<\/p><p>The change is as follows:<\/p><\/div><\/section><div class=\"avia-image-container av-nycp4c-3256a61cbe18ea47dd2f5f9ec835195c av-styling- avia-align-center avia-builder-el-18 el_after_av_textblock el_before_av_textblock \"><div class=\"avia-image-container-inner\"><div class=\"avia-image-overlay-wrap\"><table class=\"w-fit min-w-(--thread-content-width)\" data-start=\"95\" data-end=\"1048\"><thead data-start=\"95\" data-end=\"202\"><tr data-start=\"95\" data-end=\"202\"><th data-start=\"95\" data-end=\"146\" data-col-size=\"xl\"><strong data-start=\"97\" data-end=\"113\">The Old Law:<\/strong><\/th><th data-start=\"146\" data-end=\"202\" data-col-size=\"xl\"><strong data-start=\"148\" data-end=\"164\">The New Law:<\/strong><\/th><\/tr><\/thead><tbody data-start=\"311\" data-end=\"1048\"><tr data-start=\"311\" data-end=\"416\"><td data-start=\"311\" data-end=\"361\" data-col-size=\"xl\"><strong data-start=\"313\" data-end=\"343\">National Exhaustion System<\/strong><\/td><td data-start=\"361\" data-end=\"416\" data-col-size=\"xl\"><strong data-start=\"363\" data-end=\"398\">International Exhaustion System<\/strong><\/td><\/tr><tr data-start=\"417\" data-end=\"522\"><td data-start=\"417\" data-end=\"467\" data-col-size=\"xl\"><strong data-start=\"419\" data-end=\"448\">Disables Parallel Imports<\/strong><\/td><td data-start=\"467\" data-end=\"522\" data-col-size=\"xl\"><strong data-start=\"469\" data-end=\"497\">Enables Parallel Imports<\/strong><\/td><\/tr><tr data-start=\"523\" data-end=\"1048\"><td data-start=\"523\" data-end=\"787\" data-col-size=\"xl\">The trademark holder does not hold the right to prohibit the use of a trademark in connection with the goods labeled with that trademark, which have been placed on the market <strong data-start=\"700\" data-end=\"729\">in the Republic of Serbia<\/strong> by the trademark holder or the person authorized by him.<\/td><td data-start=\"787\" data-end=\"1048\" data-col-size=\"xl\">The trademark holder does not hold the right to prohibit the use of a trademark in connection with the goods labeled with that trademark, which have been placed on the market <strong data-start=\"964\" data-end=\"989\">anywhere in the world<\/strong> by the trademark holder or the person authorized by them.<\/td><\/tr><\/tbody><\/table><\/div><\/div><\/div><section class=\"av_textblock_section av-jnfrqfkn-22e29912b7f06bc73898def3aac67ddc\"><div class=\"avia_textblock linkz\"><p>\u00a0<\/p><p>The changes made to the Law allow parallel imports. This means that the trademark holder cannot prohibit third parties from reselling goods that are legally placed on the market anywhere in the world. Bearing in mind the \u201cstruggle\u201d of the competent institutions over this issue, this solution represents the success of the Commission for Protection of Competition and brings joy to parallel importers.<\/p><\/div><\/section><div class=\"av-special-heading av-l46rb6c7-214232fcb19802434d57be6c09066679 av-special-heading-h2 blockquote modern-quote modern-centered avia-builder-el-20 el_after_av_textblock el_before_av_textblock av-linked-heading\"><h2>\u00a0<\/h2><h2 class=\"av-special-heading-tag\">Special Reasons for Rejecting the Trademark Registration Application<\/h2><\/div><section class=\"av_textblock_section av-jnfrqfkn-22e29912b7f06bc73898def3aac67ddc\"><div class=\"avia_textblock linkz\"><p>\u00a0<\/p><p>In addition to the absolute and relative reasons for rejecting the application, the Law has introduced the so-called special reasons. The <strong>company registered before the date of applying<\/strong> for trademark registration, or before the date of priority of that application, can file an opposition notice. This notice may prevent the registration of a trademark if the name of the company or a substantial part of it is identical or similar to the sign in the application, and the goods or services which are the subject of the company\u2019s activity are identical or similar to those in the application and are used in traffic unless the applicant for the trademark had a company of the same or similar name at the time of filing it.<\/p><p>Also, the opposition notice of the trademark holder prevents <strong>the sales agent or the applicant\u2019s representative<\/strong> from filing an application in his name without the permission of the trademark holder and having his registration approved, unless they justify their actions. This provision aims to achieve a protective function and to prevent abuses that have occurred in practice.<\/p><\/div><\/section><div class=\"av-special-heading av-2dork2d-b1e065c89bb3c108b58544460ef18086 av-special-heading-h2 blockquote modern-quote modern-centered avia-builder-el-23 el_after_av_image el_before_av_textblock av-linked-heading\"><h2>\u00a0<\/h2><h2 class=\"av-special-heading-tag\">Trademark Renewal<\/h2><\/div><section class=\"av_textblock_section av-jnfrqfkn-22e29912b7f06bc73898def3aac67ddc\"><div class=\"avia_textblock linkz\"><p>\u00a0<\/p><p>The application for renewal of the trademark should be filed at least 6 months ahead of the expiry of the registration, along with proof of the payment of the prescribed fee. In 2020, the Law introduced the duty of the Intellectual Property <strong>Office to notify (remind) the trademark holder of the expiry of the registration<\/strong>, at the earliest 6 months before the expiration of the registration. The introduction of these provisions proved to be very useful because it often happened that the holders either knowingly or unknowingly missed the deadline for payment of the administrative fees, and thus lose the trademark. However, it should be noted that although the Intellectual Property Office must send a notification, it does not hold responsibility for the renewal failure on behalf of the trademark holder.<\/p><\/div><\/section><div class=\"av-special-heading av-1zu0qlx-2bf13b3c3c3413246b1f915e3f748748 av-special-heading-h2 blockquote modern-quote modern-centered avia-builder-el-25 el_after_av_textblock el_before_av_textblock av-linked-heading\"><h2>\u00a0<\/h2><h2 class=\"av-special-heading-tag\">Trademark as an Object of Enforcement<\/h2><\/div><section class=\"av_textblock_section av-jnfrqfkn-22e29912b7f06bc73898def3aac67ddc\"><div class=\"avia_textblock linkz\"><p>\u00a0<\/p><p>Starting from 2020, trademarks can be an object of enforcement now, and that is noted in the Registry of Trademarks at the request of the parties or the competent authority conducting the enforcement procedure.<\/p><\/div><\/section><div class=\"av-special-heading av-1l7l9it-932cc7d9a154ca41dc51b96f2ec0cf25 av-special-heading-h2 blockquote modern-quote modern-centered avia-builder-el-29 el_after_av_image el_before_av_textblock av-linked-heading\"><h2>\u00a0<\/h2><h2 class=\"av-special-heading-tag\">Judicial Proceedings<\/h2><\/div><section class=\"av_textblock_section av-jnfrqfkn-22e29912b7f06bc73898def3aac67ddc\"><div class=\"avia_textblock linkz\"><p>\u00a0<\/p><p>An important novelty introduced by the current Law is that a right infringement lawsuit can also be filed <strong>against the person whose services were used in the infringement (intermediary)<\/strong>, not only against the one who violated the right. A <strong>provisional measure<\/strong> may be imposed against the intermediary as well.<\/p><p>Concerning court proceedings, the Law provides for many possibilities for imposing <strong>provisional measures<\/strong>, and the <strong>procedure for providing evidence<\/strong> is now much more regulated compared to previous regulations.<\/p><\/div><\/section><div class=\"av-special-heading av-4io311-f6b7d864aea90cb5d6680fd4f6eb7653 av-special-heading-h2 blockquote modern-quote modern-centered avia-builder-el-31 el_after_av_textblock el_before_av_textblock av-linked-heading\"><h2>\u00a0<\/h2><h2 class=\"av-special-heading-tag\">Trademark Expiry Due to Non-Use<\/h2><\/div><section class=\"av_textblock_section av-jnfrqfkn-22e29912b7f06bc73898def3aac67ddc\"><div class=\"avia_textblock linkz\"><p>\u00a0<\/p><p>In terms of the current Law, the trademark shall expire <strong>on the date on which the application for termination of the trademark for non-use is filed<\/strong>.<\/p><p>Previously, the trademark would expire within five years from the date on which the trademark was last used, that is, a period of five years from the date of registration of the trademark in the event of non-use.<\/p><\/div><\/section><div class=\"av-special-heading av-vbcqid-3e76bc3ebbcc5f1aaf4e778a0a6fd6c5 av-special-heading-h2 blockquote modern-quote modern-centered avia-builder-el-33 el_after_av_textblock el_before_av_textblock av-linked-heading\"><h2>\u00a0<\/h2><h2 class=\"av-special-heading-tag\">Assignment of the Right of Use by the License Agreement<\/h2><\/div><section class=\"av_textblock_section av-jnfrqfkn-22e29912b7f06bc73898def3aac67ddc\"><div class=\"avia_textblock linkz\"><p>\u00a0<\/p><p>The trademark holder or the applicant may assign the right to use the trademark or the application rights by concluding a license agreement.
