Lines and waiting for your turn at the counter will be replaced by simply going to the Notary public who will be in charge to undertake further actions in the procedure of registration with the cadaster.<\/p><p>By enacting <a href=\"http:\/\/www.parlament.gov.rs\/upload\/archive\/files\/lat\/pdf\/zakoni\/2018\/686-18%20lat.pdf\" target=\"_blank\" rel=\"noopener\"><strong>the Law on the procedure of registration in the Real Estate Cadaster and Utilities<\/strong><\/a> (<em>\u201cOfficial Gazette of the Republic of Serbia\u201d, no. 41\/2018, 95\/2018, 31\/2019, and 15\/2020 <\/em>\u2013 hereinafter: \u201c<strong>Law<\/strong>\u201d) significant changes have been introduced in the procedure of registration in the Real Estate Cadaster.<\/p><p>Unlike so far, when the submissions, evidence, and other acts were filed to the Real Estate Cadaster Office in the procedure of registering with the Real Estate Cadaster in the paper form (hereinafter: \u201c<strong>Office<\/strong>\u201d), the Law prescribes <strong>an<\/strong> <strong>obligatory delivery<\/strong> of the aforementioned files <strong>in the form of the electronic document, via electronic counter<\/strong> (hereinafter: \u201c<strong>e\u2013counter<\/strong>\u201d). Exceptionally, a party may submit appeals and other legal remedies, as well as the attached evidence in paper form.<\/p><p>What remains unchanged is that the request for registration in the Real Estate Cadaster, on behalf of the party, can be submitted by its legal representative, an authorized representative of the party, as well as by a natural person, legal entity, or entrepreneur, based on the power of attorney. The Law further provides for <strong>two ways of initiating the procedure for registration with the Real Estate Cadaster<\/strong>:<\/p><ul><li><em>Ex officio (meaning \u201con its own\u201d)<\/em>\u2013 By the bodies in charge of this initiation under the Law<\/li><li>Upon <a href=\"https:\/\/zuniclaw.com\/en\/foreigner-buying-property-in-serbia\/\">request of a party<\/a><\/li><\/ul><p>In the following text, we will present the course of the <em>ex officio <\/em>registration procedure. For better understanding, we will look at the procedure from the aspect of the three usual phases.<\/p><\/div><\/section><div class=\"av-special-heading av-hzmv3y-7599bb9154933bc84b21d63ebae4b10b av-special-heading-h2 custom-color-heading blockquote modern-quote modern-centered avia-builder-el-12 el_after_av_textblock el_before_av_heading av-inherit-size av-linked-heading\"><h2>\u00a0<\/h2><h2 class=\"av-special-heading-tag\">Ex Officio Registration Procedure<\/h2><\/div><div class=\"av-special-heading av-f6agim-82e0b12882f979a5411f2ef8eb65b89f av-special-heading-h3 custom-color-heading blockquote modern-quote avia-builder-el-13 el_after_av_heading el_before_av_textblock av-inherit-size av-linked-heading\"><h3>\u00a0<\/h3><h3 data-start=\"75\" data-end=\"122\">Phase One: Submission of Relevant Documents<\/h3><\/div><section class=\"av_textblock_section av-ss8pda-521e6b507c01afb124341d52310e64dc\"><div class=\"avia_textblock\"><p>\u00a0<\/p><p>The rule is that the procedure for registration with the Real Estate Cadaster is initiated by the Office, <em>ex officio<\/em>. The Office initiates the procedure <strong>immediately after it receives the document<\/strong> delivered to it <em>ex officio <\/em><strong>by bodies tasked with this delivery <\/strong>under the Law. Bodies tasked with the delivery <em>ex officio<\/em> under the law are bodies that are obliged to deliver the documents which they issue, compose, authenticate or certify to the Office via e\u2013counter:<\/p><ul><li>Courts<\/li><li>Notaries Public<\/li><li>Public bailiffs<\/li><li>Public administration bodies and other bodies and organizations, through conducting public authorities, issue decisions that represent a ground for registration in the real estate cadaster, deliver executive decisions, and other acts which represent the appropriate ground for registration in the real estate cadaster.<\/li><\/ul><p>\u00a0<\/p><p>In addition, immediately upon receipt of the document, the Office issues an electronic certification of delivery to the body that delivered the document. Electronic certification is also issued to the party that files the application for registration, immediately after the application is received.<\/p><p>Submitting entities who use the via e \u2013 e-counter, deliver the document to the Office, which is a legal ground for registration of change with the Real Estate Cadaster, as well as other documents provided by the Law. The Law stipulates <strong>deadlines <\/strong>in which <strong>the submitting entities are obliged to effect delivery to the Office<\/strong>:<\/p><ul><li>Notary public \u2013 24h as of the moment of creating, certifying, or authenticating a Notary public\u2019s document, and of the date of which the decision that the Notary public has issued in entrusted authority, becomes executive (for example, a decision on inheritance), about which it issues a confirmation to the parties;<\/li><li>Court \u2013 3 working days as of the date of which the decision, which is issued in a case in which it conducted the first-instance procedure, becomes executive;<\/li><li>Public bailiff \u2013 in the period prescribed by the law which regulates execution and security;<\/li><li>State authority, local authority, and other subjects \u2013 24h as of the date of which the decision, which constitutes a ground for registration, becomes executive.<\/li><\/ul><p>\u00a0<\/p><p>When it comes to the Notary public, unlike the present practice, when a Notary public inspects the originals of documents, and then puts copies of those documents in their file, from now on, the parties will have to hand over the originals to the Notary public. Based on those originals, the Notary creates the electronic document, which they deliver to the Office.<\/p><p>If the delivery of the document is conducted <strong>Notary public<\/strong>, he is obliged to deliver the adequate tax returns to the Office. Depending on the fact whether the ownership right is based on the real estate sale and purchase agreement, present, or inheritance, the Notary public <strong>delivers<\/strong> <strong>to the Office<\/strong> <strong>the tax return<\/strong> for estimating <strong>the tax on the transfer of absolute rights<\/strong>, or the tax return for estimating <strong>the tax on the inheritance and present<\/strong>, as well as the tax return for estimating <strong>the property tax<\/strong> related to the transfer which is conducted by that document, except if the person obliged to file those tax applications refuses to have those filed by the Notary public.<\/p><p>It is important to stress that the Notary public is not authorized to fill in the aforementioned tax applications, but rather to if the party wishes to, fill in tax applications and deliver them to the tax authorities.<\/p><\/div><\/section><section class=\"av_textblock_section av-p5lk3i-5bbb3a1ce1cb0dddfe617f086f6f9758\"><div class=\"avia_textblock\"><p>You are probably wondering what kind of administrative fees you should expect now when the Notary Public undertakes all legal actions for the registration procedure.<\/p><p>As for <strong>the<\/strong> <strong>fees<\/strong> for the Notary public services, the exact amount is still to be determined. That will be done once the scope of work and of work workforce\u2019s engagement in this form of activity of the Notary public is determined<\/p><\/div><\/section><div class=\"av-special-heading av-ec77lq-e90bc6b1a999ec46633e06371244d626 av-special-heading-h3 custom-color-heading blockquote modern-quote avia-builder-el-18 el_after_av_textblock el_before_av_textblock av-inherit-size av-linked-heading\"><h3>\u00a0<\/h3><h3 data-start=\"90\" data-end=\"147\">Phase Two: Initiating the Procedure and Formal Checks<\/h3><\/div><section class=\"av_textblock_section av-p5lk3i-5bbb3a1ce1cb0dddfe617f086f6f9758\"><div class=\"avia_textblock\"><p>\u00a0<\/p><p>Right after the delivery is performed by the bodies tasked with it, the second phase of the procedure is started. <strong>The Office<\/strong>, without delay, commences with the registration procedure, and the <strong>document<\/strong>, based on which the transfer of property on real estate is effected, via e-counter, is delivered<strong>\u00a0to the tax authority<\/strong> authorized to estimate the amount of the tax on the transfer of absolute rights, or tax on inheritance and present.<\/p><p>In the same manner, <strong>the Office<\/strong> <strong>also<\/strong> <strong>forwards the document to the local authority<\/strong> authorized with estimation, payment, and control of its own revenue sources of local government, for the purpose of estimation of tax on property, as well as to <strong>the company<\/strong> locally competent for unified payment of <strong>communal services<\/strong>.<\/p><p>If the Office has received a tax report from a Notary public along with the document, following what we have been talking about in this blog post so far, the Office forwards these to the tax authority or the local authority. The Office then checks if <strong>the formal requirements for registration <\/strong>are fulfilled (competence of the Office; is the document, which constitutes a legal ground for registration <em>ex officio<\/em>, delivered, as well as other documentation provided by law, and similar.).<\/p><p>Additionally, if the <strong>court,<\/strong> <strong>Notary public, or a public bailiff<\/strong> has <strong>delivered<\/strong> the document, <strong>the Office does not check<\/strong> whether <strong>the document<\/strong> is issued, composed, certified, or authenticated <strong>in the scope of competence of these bodies under the law<\/strong>.<\/p><p>Furthermore, if the formal requirements for registration are fulfilled, the Office does not check the legality of change which is being carried out following the document delivered, since the body tasked with delivery was concerned with that in the procedure of issuing, composing, certifying, or authenticating that document, and which is confirmed by the very act of delivery to the Office. The Office issues a <strong>decision<\/strong> that <strong>affects<\/strong><strong> registration<\/strong> of such a <strong>change<\/strong> with the cadaster unless the law prohibits registration in such cases.<\/p><\/div><\/section><div class=\"av-special-heading av-cqo3f2-c36af14b2df47f386ac6454236d1bb6d av-special-heading-h3 custom-color-heading blockquote modern-quote avia-builder-el-20 el_after_av_textblock el_before_av_textblock av-inherit-size av-linked-heading\"><h3>\u00a0<\/h3><h3 data-start=\"68\" data-end=\"102\">Phase Three: Decision Issuance<\/h3><\/div><section class=\"av_textblock_section av-p5lk3i-5bbb3a1ce1cb0dddfe617f086f6f9758\"><div class=\"avia_textblock\"><p>\u00a0<\/p><p>The Office pays attention to whether the conveyancing of the ownership rights is in accordance with the imperative terms. In case the Office finds that the disposal of real estate in the document which is the ground for registration is contrary to imperative laws, the Office effects registration based on that document in the cadaster. Immediately, the Office notifies the body, which is competent to initiate, <em>ex officio<\/em>, the appropriate procedure for annulling that document, as well as the public prosecutor, and it registers a note on these notifications in the cadaster.<\/p><p>Per the Law, the Office is obliged to issue the decision within <strong>5 working days as of the day of delivery of the document<\/strong> for registration.<\/p><\/div><\/section><div class=\"av-special-heading av-a7wrym-851ceed460e1f902b0063eec9b095579 av-special-heading-h2 custom-color-heading blockquote modern-quote modern-centered avia-builder-el-22 el_after_av_textblock el_before_av_hr av-inherit-size av-linked-heading\"><h2>\u00a0<\/h2><h2 class=\"av-special-heading-tag\">Registration Procedure Upon Party\u2019s Request<\/h2><\/div><section class=\"av_textblock_section av-k7u60e-dc1d808215ea235c8ecbe58d19952402\"><div class=\"avia_textblock\"><p>\u00a0<\/p><p data-start=\"65\" data-end=\"223\"><strong data-start=\"65\" data-end=\"223\">As previously explained, registration with the real estate cadaster is typically initiated ex officio. However, as with most rules, there is an exception.<\/strong><\/p><p><strong>As an exception to the rule <\/strong>is possible to initiate this procedure by a party by <strong>filing a request via e-counter<\/strong> (unless that is explicitly excluded by the law).<\/p><p>In the request, the party may ask for the decision upon submitted request, to be delivered via registered mail to the desired address or directly on the premises of the Office, in which case the party will receive the transcript of the decision issued in the electronic form. If it does not do so, the decision will be delivered to the party in the form of an electronic document to the email address which the party specified in its request as its email address, bearing in mind that the request itself was submitted in the electronic form.<\/p><p>Right after the request has been received, <strong>the Office<\/strong> without delay starts the registration procedure, and <strong>the document<\/strong> based on which the property transfer on real estate is being affected, <strong>via e\u2013counter<\/strong>, is <strong>forwards to the tax authority and the local authority <\/strong>competent for estimation, payment, and control of source revenues of the local authority, just as in the procedure <em>ex officio<\/em>.<\/p><p>Following the reception of the request for registration, <strong>the Office checks<\/strong> whether <strong>formal requirements<\/strong> for registration in the real estate cadaster are satisfied (competence of the Office; whether the request is filed by an authorized person; whether the request contains all the prescribed data, and similar.). That is the similarity with the procedure initiated <em>ex officio<\/em>.<\/p><p>The main difference between these two procedures, the one initiated <em>ex officio<\/em> and the one initiated by the party, is the deadline the office in which the Office has to decide upon the request.<\/p><p>The Office will rule on the request for registration in <strong>15 days as of the day it received the request<\/strong>. However, in the case of registration of mortgage, registration of the note of hypothecary sale, as well as in the simple administrative matters, this deadline is the same as in the procedure for registration initiated ex officio, and that is 5 working days as of the day of<a href=\"https:\/\/zuniclaw.com\/en\/akz\/vitomir-zunic\/\"> reception of the request.<\/a><\/p><\/div><\/section><div class=\"av-special-heading av-9cil8e-84bd6287ccb89619b42e8e3829844244 av-special-heading-h2 custom-color-heading blockquote modern-quote modern-centered avia-builder-el-26 el_after_av_textblock el_before_av_heading av-inherit-size av-linked-heading\"><h2>\u00a0<\/h2><h2 class=\"av-special-heading-tag\">Appeal<\/h2><\/div><div class=\"av-special-heading av-6y9b3y-261d6de32d0466d0807b927a8a9b7a62 av-special-heading-h2 custom-color-heading blockquote modern-quote avia-builder-el-27 el_after_av_heading el_before_av_textblock av-linked-heading\"><h2>\u00a0<\/h2><h3 class=\"av-special-heading-tag\">Deadline for Submitting Appeal<\/h3><\/div><section class=\"av_textblock_section av-g9zuum-a878c37ccab30073cf73ac19e113d148\"><div class=\"avia_textblock\"><p>\u00a0<\/p><p>Against the first\u2013instance decision, regardless of whether it has been issued <em>ex officio<\/em> or on a party\u2019s request, the party has the right to appeal.<\/p><p>The party may submit an appeal to the Republic geodetic office (hereinafter: \u201c<strong>Republic office<\/strong>\u201d), which is handed over to the competent Office, in <strong>8 days as of the day of delivery of the first-instance decision<\/strong>.<\/p><p><strong><em>THE OFFICE\u2019S PROCEDURE CONCERNING THE SUBMITTED APPEAL:<\/em><\/strong><\/p><p>After receiving the appeal, the Office has <strong>7 days <\/strong>to act in one of the following ways:<\/p><ul><li><strong>Dismiss the appeal<\/strong>\u2013 check the formal requirement of the appeal, therefore, the issued decision on the dismissal of the appeal, if the appeal has not been submitted in the prescribed period, if the appeal is not allowed if the appeal has not been submitted by an authorized person<\/li><li><strong>Adopt the appeal, annul the first\u2013instance decision, and issue a new decision <\/strong>if it finds that the appeal is founded.<\/li><li><strong>Appeal, <\/strong>along with the case files, is <strong>forwarded to the Republic office for further procedure<\/strong>\u00a0if it finds that it cannot act under points 1 or 2 above.<\/li><\/ul><p>\u00a0<\/p><p><strong>Exceptionally<\/strong>, if adopting the appeal could badly affect the rights and interests of a person in whose favor registration is allowed, or of a person registered in the cadaster on that real estate, <strong>the appeal will be delivered for a reply<\/strong> to that person. In that case. The person who is obliged to deliver its reply to the Office in the period of <strong>8 days<\/strong>.<\/p><h3 data-start=\"76\" data-end=\"124\">\u00a0<\/h3><h3 data-start=\"76\" data-end=\"124\">Deadline for Issuing a Decision on an Appeal<\/h3><p data-start=\"126\" data-end=\"199\" data-is-last-node=\"\" data-is-only-node=\"\">\u00a0<\/p><p data-start=\"74\" data-end=\"213\">The Republic Office is required to issue a decision on the appeal <strong>within 60 days<\/strong> from the date it receives a properly submitted appeal.<\/p><p data-start=\"76\" data-end=\"129\">\u00a0<\/p><h3 data-start=\"76\" data-end=\"129\">Republic Office\u2019s Actions on the Submitted Appeal<\/h3><p data-start=\"131\" data-end=\"228\" data-is-last-node=\"\" data-is-only-node=\"\">\u00a0<\/p><p>The Republic office may:<\/p><ul><li>Reject the appeal<\/li><li>Annul the first\u2013instance decision in whole or in part, and decide on the appeal on its own<\/li><li>Annul the first\u2013instance decision and return the case to the first\u2013instance body (that is, to the competent Office, which has issued the first\u2013instance decision against which the appeal was submitted) for a new procedure<\/li><li>Modify the first\u2013instance decision<\/li><\/ul><h3>\u00a0<\/h3><h3>Court Protection<\/h3><p>\u00a0<\/p><p data-start=\"69\" data-end=\"389\">After the Republic Geodetic Authority, as the second-instance body, issues its decision, it is possible to initiate an administrative dispute. This form of judicial protection before the Administrative Court can also be initiated if the Authority fails to decide on the appeal within the legally prescribed deadline.<\/p><\/div><\/section><div class=\"av-special-heading av-6fcd7y-18589add9738bf74979b56fa562a6dfc av-special-heading-h2 custom-color-heading blockquote modern-quote modern-centered avia-builder-el-29 el_after_av_textblock el_before_av_heading av-inherit-size av-linked-heading\"><h2>\u00a0<\/h2><h2>Transition to the New Real Estate Cadaster Registration System<\/h2><h3 data-start=\"335\" data-end=\"401\">\u00a0<\/h3><h3 data-start=\"335\" data-end=\"401\">How the New Law Differs from the Previous Cadaster Regulations<\/h3><p data-start=\"403\" data-end=\"479\">\u00a0<\/p><\/div><section class=\"av_textblock_section av-adq6ji-db250fff7f94841309cedeb54d65a206\"><div class=\"avia_textblock\"><p data-start=\"276\" data-end=\"708\">If a party submitted a request for registration <em data-start=\"378\" data-end=\"385\">after<\/em> the new Law on the Procedure of Registration in the Real Estate Cadaster and the Cadaster of Lines came into force\u2014but the registration is based on a court decision or a decision from another competent or public authority <em data-start=\"608\" data-end=\"623\">issued before<\/em> the new law\u2019s enactment\u2014then the procedure will be conducted under the previous law.<\/p><h3 data-start=\"985\" data-end=\"1225\">\u00a0<\/h3><h3 data-start=\"985\" data-end=\"1225\">Procedures Governed by the New Law<\/h3><p data-start=\"985\" data-end=\"1225\">\u00a0<\/p><p data-start=\"985\" data-end=\"1225\">Registrations based on decisions made <strong data-start=\"1064\" data-end=\"1073\">after<\/strong> the new law came into force will be processed under the <strong data-start=\"1130\" data-end=\"1224\">Law on the Procedure of Registration in the Real Estate Cadaster and the Cadaster of Lines<\/strong>.<\/p><p data-start=\"1227\" data-end=\"1286\">This includes documents that were composed or certified by:<\/p><ul data-start=\"1287\" data-end=\"1392\"><li data-start=\"1287\" data-end=\"1314\"><p data-start=\"1289\" data-end=\"1314\"><strong data-start=\"1289\" data-end=\"1308\">Notaries public<\/strong>, or<\/p><\/li><li data-start=\"1315\" data-end=\"1392\"><p data-start=\"1317\" data-end=\"1392\"><strong data-start=\"1317\" data-end=\"1327\">Courts<\/strong>, in cases where they performed these tasks in place of notaries.<\/p><\/li><\/ul><\/div><\/section><div class=\"av-special-heading av-2quk9a-66aeb7d511d47a7e0a48ecd7898b8fc0 av-special-heading-h2 custom-color-heading blockquote modern-quote avia-builder-el-32 el_after_av_textblock el_before_av_textblock av-inherit-size av-linked-heading\"><p data-start=\"302\" data-end=\"539\">To modernize and streamline the <strong data-start=\"334\" data-end=\"371\">real estate cadaster registration<\/strong> process, the applicable law defines clear deadlines by which public bodies must begin delivering documents <strong data-start=\"479\" data-end=\"493\">ex officio<\/strong> via Serbia\u2019s <strong data-start=\"507\" data-end=\"538\">e-Counter system (e-\u0161alter)<\/strong>.<\/p><h4 data-start=\"541\" data-end=\"563\">\u00a0<\/h4><h4 data-start=\"541\" data-end=\"563\">Notaries Public<\/h4><p data-start=\"564\" data-end=\"791\">\u00a0<\/p><p data-start=\"564\" data-end=\"791\">As of <strong data-start=\"570\" data-end=\"586\">July 1, 2018<\/strong>, <strong data-start=\"588\" data-end=\"607\">notaries public<\/strong> are required to deliver\u2014<strong data-start=\"632\" data-end=\"646\">ex officio<\/strong>\u2014all documents they <strong data-start=\"666\" data-end=\"703\">compose, certify, or authenticate<\/strong>, along with any <strong data-start=\"720\" data-end=\"744\">decisions they issue<\/strong> that become enforceable on or after this date.<\/p><h4 data-start=\"793\" data-end=\"806\">\u00a0<\/h4><h4 data-start=\"793\" data-end=\"806\">Courts<\/h4><p data-start=\"807\" data-end=\"1054\">\u00a0<\/p><p data-start=\"807\" data-end=\"1054\">For <strong data-start=\"811\" data-end=\"821\">courts<\/strong>, the obligation begins later.
